Florida Laws And Regulations On Selling Used Baby Furniture

Car Seats


According to the Florida Department of Highway Safety and Motor Vehicles, all children, ages five and under must be restrained in a child restraint device that has been crash-tested and federally approved. There is no law against selling used car seats, however all car seats should be under six years old, in good condition, and should retain the manufacturers label according to the Juvenile Products Manufacturers Association. In addition, car seats that have been in a crash, even a minor one, should be discarded,as their safety is no longer ensured.


Cribs


Though there is no Florida law regarding the use of used cribs. The U.S. Consumer Product Safety Commission states that cribs that do not meet the the requirements of federal regulation are banned and considered hazardous substances and should therefore be discarded. Current crib requirements include (among others) slats that are no further than 2 3/8" apart, corner posts that are no more than 1/16" higher than the end panels, and headboards and foot boards free of cutouts and designs that a child could get stuck in. In addition, the Juvenile Products Manufacturers Association recommends that all cribs sold meet the current American Society for Testing and Materials (ASTM) standards.


Bedding


According to the 2009 Florida StatuesFlorida Laws and Regulations on Selling Used Baby Furniture, it is illegal to sell any used bedding that is unlabeled, including any baby bedding. Bedding is defined as any mattress, box spring, pillow or cushion that

can be filled wholly or partly with any material and can be used for human sleeping or reclining. Used bedding must be labeled with a minimum of a one inch by two inch label that lists and explains the materials used

and the amounts present. The label should be firmly attached to the bedding and visible before purchase.


Other Furniture


While there are currently no laws regarding the resale of other types of used baby furniture in FloridaFlorida Laws and Regulations on Selling Used Baby Furniture, the Juvenile Products Manufacturers Association recommends all products designed for use with babies or infants be used correctly every time, and inspected for safety before each use. In addition, all products should meet any current state and federal safety guidelines, as well as those provided by the ASTM before being resold.
