Oklahoma House Advances Legislation Banning Sharia Law
just got home and got this wonderful thing in the email!

March, 2010

OKLAHOMA CITY – "State lawmakers have voted to allow Oklahoma voters to prevent judicial rulings in foreign countries from impacting local court decisions through approval of the "Save Our State" constitutional amendment.
House Joint Resolution 1056, by state Rep. Rex Duncan, would allow Oklahomans to vote to amend the Oklahoma Constitution to require the courts to "uphold and adhere to the law" as provided in the United States Constitution, the Oklahoma Constitution, the United States Code and federal regulations, Oklahoma Statutes and rules, and established common law.
The proposed amendment would prohibit all Oklahoma courts from considering the legal precepts of other nations or cultures, even in cases of first impression.
"Unfortunately, some judges in other states and on the federal bench have begun to cite international law in their court decisions, effectively undermining our own democratic system of government," said Duncan, a Sand Springs Republican and attorney who chairs the House Judiciary Committee. "Our nation’s laws were developed through a democratic process and should not be undermined by haphazard reliance on foreign rulings developed in autocratic societies. Oklahoma court decisions should be based on the U.S. Constitution, Oklahoma Constitution, and our state and national laws—period."
The proposed amendment declares that courts "shall not consider international law or Sharia Law."

THANK GOODNESS OUR ENTIRE STATE LEGISLATOR IS REPUBLICAN, AND THE CITIZENS OF OKLAHOMA WILL VOTE THIS INTO LAW! AND DAMN OBAMACARE TO HELL WE ARE GOING TO FIGHT IT TO DEATH HERE IN OKLAHOMA!

While I understand considering foreign laws has it's place-- mostly as an intellectual exorcise, perhaps regarding federal cases with utterly no precedent. However, isn't Syariah/Sharia law one of religion, and therefore has no place in a country where church does not rule the state?
Furthermore, why would local and state judges look to international laws? If it's an unprecedented case in the area, wouldn't it be easier to look to other cities, counties, or states with similar laws to see their rulings? Compare apples to apples, as it were.

yes as an intellectual exericse, especially in the political science realm or for Congressmen to play with, as well as those federal cases. Yes while it is one of religion, for many countries they governor by religious law if ya will remember ;) they don't take too kindly to us hahaha and if events in Europe are any sign of how they feel about us, the Europeans are having to fight back against Sharia law imposing itself on Europe and their courts too. Then again it is also wrong for the French to try and ban burkas (sp?), I think its a public ban, I think it should just not be allowed in school, otherwise let them wear them, its like the Jewish hats... I am not remembering names right now...

not sure, but they are, especially in more liberal states *_*;;;; and its been tried here in Oklahoma, we have had one case that I know of, and I think there are more *_* Yes you are right about the states and their laws, and usually is true!

In studying the debate over the French rule against the wearing of obvious religious gear (not just burkas and hijab, mind you-- ALL obvious gear), I did hear that an important Imam coming out and saying that all Moslems should adhere to the rules of the country in which they are living. So, the reference to Sharia law in a secular country's judicial system makes no sense.
But, it's religion. Religion is like that, sometimes. No matter how loudly or often you say that you don't need to be saved, someone always insists that you do and tries to do it.

thats good that one of the Imams would, but rare too I would think *_* haha yeah it does make no sense, but we still have cases of U.S. judges actually trying to make reference to it here!
